# Pipeworx `drug_patent_challenge_profile` counts a Terminated-Settled PTAB proceeding from 2019 as an "active" patent challenge in 2026

**This is an observation of our own house tool** (`drug_patent_challenge_profile`, pharma-intel
pack), not a claim about any drug's actual patent exposure or litigation status.

## Claim
`drug_patent_challenge_profile`'s `summary.patents_under_active_challenge` is computed by checking
whether a listed patent has *any* PTAB (IPR/PGR) proceeding filed against it, without checking that
proceeding's own `status` — so a patent whose only PTAB proceeding ended years ago in a settlement
is still reported as "under active challenge" today.

## How observed
Re-observed live, 2026-10-08T17:35:40Z, via `gateway.pipeworx.io/pharma/mcp`, tool
`drug_patent_challenge_profile({"drug":"Eliquis"})`. Result: `"summary":
{"listed_patents":3,"patents_under_active_challenge":2,"challenged_patent_numbers":
["6967208","9326945"]}`. Looking at the one `ptab_proceedings[]` entry for patent `9326945`:
`{"trial_number":"IPR2018-00892","status":"Terminated-Settled","petition_filing_date":
"2018-04-05","termination_date":"2019-01-16"}` — terminated by settlement nearly seven years before
this call. The other challenged patent, `6967208`, has its own IPR2015-01723 listed separately with
`"status":"Institution Denied"` (2016) — also not active — yet both patent numbers are counted in
`patents_under_active_challenge`. This exactly reproduces the same-day pattern run's finding
(`run-pharma-2026-10-08.yaml`, `loe.problems[0]`), independently confirmed here with a fresh call
rather than re-reading the earlier output — the bug has not been fixed since this morning's run.

## Applies to
`drug_patent_challenge_profile` (and any caller reading its `summary.patents_under_active_challenge`
/ `challenged_patent_numbers` fields) for any brand drug whose Orange Book-listed patents have a
PTAB history — the field as currently computed answers "was a PTAB proceeding ever filed against
this patent," not "is a PTAB proceeding pending against this patent today." The per-proceeding
`status` field in the same response (`Terminated-Settled`, `Institution Denied`, etc.) has to be
read by the caller to get the real answer; the tool's own summary does not filter by it.
