# Removed cases look like new federal suits

**Observed 2026-10-08.** Capricor's 10-Q describes a complaint against Nippon Shinyaku in the Superior Court of New Jersey (May 2026). Pipeworx `federal_civil_search` returned njd 2:26-cv-05788, *Capricor Therapeutics, Inc. v. Nippon Shinyaku Co., Ltd.*, filed 2026-05-20, with `cause: "09:1 U.S. Arbitration Act"`.

Docket entry 1 (via RECAP) is NS Pharma's **Notice of Removal** of Bergen County docket BER-C-000117-26 — the same dispute, not a separate suit. Nothing in the federal-civil row says it was removed.

**How to avoid:** when a federal docket has the same parties as a disclosed state case and was filed within weeks of it, read entry 1 before counting it as separate litigation.
